It doesn't, I have had a Flex set to 3 for my motorcycles for years and always use the express lanes, it has never registered on my Fastrak account a single time. (For anyone that doesn't have a motorcycle, this is how you're supposed to set your Flex, even with a solo rider. Express lanes are always free for bikes.)
